Withdrawal from the Contract and Return of Goods

A consumer or a business acting as a consumer may withdraw from a distance contract without giving any reason within 14 days of receiving the Goods. In the case of multiple items delivered separately, in batches, or in parts, the period begins upon receipt of the last item, batch, or part.

1. Submit a notice

Before the 14-day period expires, send an unambiguous notice of withdrawal:

• by email to sklep@smartbest.pl or
• by mail to SMARTBEST sp. z o.o., ul. Dworcowa 28/22, 14-400 Pasłęk.

You may use the withdrawal form, but it is not required. To meet the deadline, it is sufficient to send the notice before the deadline expires; withdrawal does not require approval by the Store.

2. Return the Goods

The goods must be returned no later than 14 days after you notify us of your withdrawal to the following address:

The direct cost of returning the Goods is borne by the Customer, unless the Store has agreed to cover it or has failed to inform the Customer of this obligation. For your convenience, you may use any carrier or the optional InPost Quick Returns service. Using this service does not affect the validity of your withdrawal.

We recommend securely packaging the Goods and retaining proof of shipment. It is advisable to include the Order number in the package to expedite the identification of the return.

3. Inspecting the Goods

You may unpack and inspect the Goods to the extent necessary to determine their nature, characteristics, and functionality—just as you would in a brick-and-mortar store. Simply opening the package does not void your right to return the Goods.

You are liable for any reduction in the value of the Goods only if you use them in a manner that goes beyond what is necessary for such inspection. In such a case, the refund amount may be reduced accordingly to reflect the actual reduction in value.

4. Refund

We will refund all payments received, including the cost of the cheapest standard shipping method offered in the Store, no later than 14 days from receipt of the notice of withdrawal. If a more expensive delivery method was selected, the difference above the cost of the cheapest standard delivery is non-refundable.

The refund will be issued using the same payment method used for the purchase, unless you expressly agree to a different method that does not involve additional costs.

We may withhold the refund until we receive the Goods or until you provide proof of their return—whichever occurs first.

5. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the cases specified in Article 38 of the Consumer Rights Act. In the Store’s product range, this may apply in particular to:

• Goods made to the Customer’s specifications or intended to meet their individual needs;
• Goods delivered in sealed packaging that cannot be returned after opening for health or hygiene reasons, if the packaging was opened after delivery;
• other cases expressly specified in the Act and—if they apply to a given Good—in its description.

The Store’s standard shipping packaging does not constitute sealed hygienic packaging within the meaning of this exception.
